Current Cases
BoiesBattin represents clients in myriad litigation around the country. Our attorneys serve as lead counsel or in leadership roles in some of the nation’s largest antitrust and consumer protection class actions. The following are select cases the firm is is currently litigating:
Blue Cross Blue Shield Litigation
As a member of the Trial Committee, BoiesBattin is helping to represent millions of Blue Cross Blue Shield subscribers nationwide against the Blue Cross Blue Shield entities. Alleging the health insurance companies entered into agreements not to compete, in 2017 the court determined that the agreements to allocate territories should be reviewed according to the per se treatment under the Sherman Act. In November 2020, the Court granted preliminary approval of a proposed settlement for the Blue Cross Blue Shield subscribers totaling $2.67 billion, with additional injunctive relief to help encourage competition in the health care industry.
Cathode Ray Tube (CRT)
BoiesBattin is serving a leading role in the CRT litigation. Plaintiffs allege that CRT manufacturers conspired to fix the prices of CRT screens used for computer monitors and televisions. Approval for settlements totaling over $500 million was granted by the United States Court for the Northern District of California, where litigation for the case continues.
Local Television Advertising
BoiesBattin is helping to represent buyers of local televisions spot advertising space against broadcast television station owners in over one hundred and fifty media markets across the country. Alleging the Defendant companies have conspired to fix prices and share competitive information allowing them to overcharge their customers, BoiesBattin seeks to recover for class members that were forced to pay non-competitive prices for television advertising.
Broilers Chicken
BoiesBattin attorneys are representing restaurants that purchased broiler chicken from some of the largest chicken producers in the nation. Alleging the producers sought to raise the price of chicken by conspiring to reduce supply, settlements have already been reached with a number of producers for over $100 million.

Northwestern Mutual Life Insurance Annuity Litigation
BoiesBattin was co-lead counsel on behalf of thousands of purchasers of certain Northwestern Mutual Life Insurance Company (“Northwestern”) annuities. In a lawsuit accusing Northwestern of deliberately stripping annuity policyholders of their dividend rights, BoiesBattin helped achieve a $84 million settlement in the United States District Court for the Eastern District of Wisconsin for the policyholders.
Dynamic Random Access Memory (DRAM)
BoiesBattin acted as co-lead counsel in coordinated multi-state proceedings against the manufacturers of Dynamic Random Access Memory chips (“DRAM”) for the violation of various antitrust/consumer protection laws. Plaintiffs alleged that the DRAM manufacturers conspired to suppress and eliminate competition by fixing the prices of DRAM. Our attorneys achieved settlements totaling more than $300 million approved by the United States Court for the Northern District of California.
Thin-Film Transistor Liquid Crystal Display (TFT-LCD)
BoiesBattin served a leading role in the TFT-LCD litigation. Plaintiffs alleged that defendants conspired to fix the prices of TFT-LCD panels used in laptop computers, computer monitors, and televisions. This case was settled for $1.1 billion in the United States District Court for the Northern District of California.
Food Additives
As sole lead counsel, BoiesBattin effectively advanced the claims of indirect purchasers alleging the manufacturers of monosodium glutamate and nucleotides had engaged in a long running antitrust conspiracy. BoiesBattin received final approval of a $40 million global settlement.
Indirect Purchaser Vitamins Litigation
BoiesBattin served as sole lead counsel in coordinated multistate proceedings involving more than 50 indirect purchaser and parens patriae actions pending in 23 separate state jurisdictions against the international manufacturers of bulk vitamins. BoiesBattin secured the largest ever indirect purchaser antitrust settlement at that time of over $225 million dollars.

Fragrances
Fragrance chemicals are found in a vast array of consumer products, including perfumes, shampoos, home cleaning products, and scented candles. Our attorneys are investigating allegations of a price-fixing cartel engaged in by the largest manufacturers of these chemicals around the world.
DraftKings
BoiesBattin is investigating claims that DraftKings misled consumers by advertising “risk-free” bets promotions that were, in fact, not risk-free.
Concrete and Mortar Admixtures
BoiesBattin is investigating allegations that the largest producers and sellers of construction chemical admixtures have agreed to fix prices for the sale of these admixtures, unfairly increasing the cost for purchasers of these chemicals for use in concrete, cement, and mortar construction jobs across the country.
The Right to Repair
Our attorneys are investigating claims that John Deere requires that a significant portion of needed repairs for John Deere farm equipment be done exclusively by John Deere licensed repair companies, increasing the price for repairs by restricting the owner’s right to select repair service providers.
